K-2 CURB LINES AND GRADES

K-2-1 PURPOSE

The purpose of this chapter is to establish the policies regarding the construction and maintenance of the curbs and gutters within in the City of Fort Pierre.

K-2-2 CURB LINES AND GRADES

A record of curb lines and grades shall be maintained by the Director of Public Works or his designee and any curb and gutter hereinafter installed or replaced within the City of Fort Pierre must conform to the established lines and grades recorded in the Public Works Department.

K-2-3 PROSPECTIVE CURB LINES

If it is established that no record of curb lines is on file in the Public Works Department, a written letter of application accompanied by a copy of the most recently recorded plat of the area shall be sent to the Director of Public Works. The Director of Public Works or his designee shall thereupon establish such lines. The applicant shall be advised of this determination within thirty (30) days, and may appeal this as any other decision of a City official.

K-2-4 FAILURE TO OBSERVE ESTABLISHED CURB LINES AND GRADES

Any property owner installing curb who does not comply with the curb lines and grades on file in the Public Works Department may be assessed against the property the cost of replacement by the City.

K-2-5 PUBLIC OR BUSINESS DRIVEWAYS ACROSS CURB LINES

Public driveways over or across curb lines for filling stations, public garages, retail and wholesale business establishments, shall not exceed forty (40) feet in width, and where two (2) driveways are constructed along one (1) street line, there shall be a minimum of fifteen (15) feet between each driveway except as otherwise approved by the City Council. No driveway shall be constructed within ten (10) feet of any block corner.

K-2-6 PRIVATE DRIVEWAYS ACROSS CURB LINES

Private driveways over and across curb lines shall not exceed thirty (30) feet in width, except as otherwise approved by the City Council, and such driveways shall not be constructed within fifteen (15) feet of any block corner.
