L-7 HOUSING STANDARDS

L-7-1 PURPOSE

The purpose of this chapter is to establish rules and regulations regarding the use of buildings and structures located within the City of Fort Pierre for residential purposes. This chapter is enacted to promote the health, safety, morals, and general welfare of the community of the City of Fort Pierre by providing proper standards regarding the type of structures that may be used as residential premises, responsibilities of landlords, and also a provision establishing penalties for violators of this chapter. Any building or structure found to be in violation of this chapter shall be considered a public nuisance.

L-7-2 DWELLING REQUIREMENTS

No person shall occupy or permit to be occupied as a dwelling any structure which:

A. Was not designed or converted for use as a human habitation.

B. Does not have functional indoor plumbing (water supply and waste disposal).

C. Lacks structural integrity sufficient to bear normal snow loads, prevent normal rainfall from entering and prevent access by rodents and other non-domestic animals.

D. Lacks ample wiring for normal electrical loads.

E. Has been condemned by the City Building Inspector or his designee or supervisor.

L-7-3 LANDLORD RESPONSIBLE

It is the responsibility of the property owner to insure that the requirements of L-7-2 are met, unless the tenant or lessee has wrongfully caused noncompliance.

L-7-4 VIOLATION

Any person in violation of any section within this chapter shall be guilty of a misdemeanor and upon conviction shall be penalized as provided in chapter T. Each day’s violation, failure, refusal or neglect to comply with, any provision of this code or regulation promulgated thereunder shall constitute a separate and distinct offense.

L-7-5 SEVERABILITY

If any provision of this chapter is declared unconstitutional or the application of this chapter to any person or circumstance is held invalid or unconstitutional, the remainder of this chapter and applicability thereof to other persons or circumstance shall not be affected thereby.
