L-5 WATER POLLUTION

L-5-1 PURPOSE

The purpose of this chapter is to provide additional and cumulative remedies to prevent, abate, and control the pollution of waters within the territorial jurisdiction of the City of Fort Pierre. It is the intention of the City Council to provide rules and regulations regarding the cleanliness of surface water located within the territorial jurisdiction of the City of Fort Pierre.

L-5-2 SURFACE WATER

It is unlawful to discharge, or cause to be discharged, human or animal waste, petroleum products, refuse, or toxic chemicals of any type into surface water located wholly or partially within the territorial jurisdiction of the City of Fort Pierre. This shall not apply to employees of the City in the course of performing duties, and is not applicable to the municipal sewer treatment facility.

L-5-3 INSECT CONTROL

Persons owning property within the City of Fort Pierre shall prevent the infestation of any water on said property by mosquitoes or other noxious insects by draining the water, covering it, or treating it so as to destroy the insects without posing a threat to the health and safety of humans or animals.

L-5-4 VIOLATION

Any person in violation of any section within this chapter shall be guilty of a misdemeanor and upon conviction shall be penalized as provided in chapter T. Each day’s violation, failure, refusal, or neglect to comply with any provision of this chapter or regulation promulgated thereunder shall constitute a separate and distinct offense.

L-5-5 SEVERABILITY

If any provision of this chapter is declared unconstitutional or the application of this chapter to any person or circumstance is held invalid or unconstitutional, the remainder of this chapter and applicability thereof to other persons or circumstance shall not be affected thereby.
