Notice of Letter of Map Revision to the Flood Map

The City of Fort Pierre Public Works Director in accordance with National Flood Insurance Program regulation 65.7(b)(1),] hereby gives notice of the City of Fort Pierre’s intent to revise the flood hazard information, generally located between the Rousseau Avenue and Islay Avenue.  Specifically, the flood hazard information shall be revised along the Missouri River from a point approximately at the intersection of Islay Avenue and Mull Street to a point approximately where Rousseau Avenue (formerly Cottontail Road) would intercept the Missouri River.

As a result of the revision the 1% annual chance floodplain shall widen and/or narrow within the area of revision.

NOTICE TO PUBLIC OF FINDING OF NO SIGNIFICANT IMPACT

AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:

 

The purpose of this notice is to identify two separate but related actions to be taken by the City of Fort Pierre.

 

On or about April 11, 2018, the above-named City of Fort Pierre will request the Governor’s Office of Economic Development (GOED) to release Federal funds under Title I of the Housing and Community Development Act of 1974 as amended (PL 97-35) for the following project:

 

City of Fort Pierre Dilapidated Structures Removal Project -the project involves the removal of dilapidated structures in order to create space for future development. The project will involve restoring each lot to a build-ready state which will include the removal and disposal of the houses including removal and disposal of any ancillary dilapidated buildings, clearing of necessary trees and bushes, removal and disposal of foundations, filling the foundations/basements/garage pads, erosion control, removing and capping water and sanitary sewer services, disconnecting electrical service, hazardous materials abatement, plus all necessary appurtenances.  The project has an estimated cost of $170,000. The project is located within Fort Pierre city boundaries in Stanley County in Sections 27, 28, 33 and 34, of Township 5N, Range 31E, of the Black Hills Meridian.

It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above-named City of Fort Pierre has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).

 

The reason for such decision not to prepare such Statement is as follows: It has been determined that there will be no significant impact to the environment due to the above-stated project.

 

An Environmental Review Record of the project has been made by the City of Fort Pierre, which documents the environmental review of the project and more fully sets forth the reasons why such Statement is not required.  This Environmental Review Record is on file and available for public examination and copying upon request at the City of Fort Pierre, 08 East 2nd Ave, Fort Pierre, South Dakota, between the hours of 8:00 a.m. to 5:00 p.m. CDT Monday thru Friday.  No further Environmental Review of this project is proposed prior to the request for release of Federal funds.

 

All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration by the city to the City of Fort Pierre. Comments should specify which notice, Finding of No Significant Impact, or Intent to Request Release of Funds, is being addressed. Such written comments will be received by Gloria Hanson, Mayor and Certifying Officer, PO Box 700*08 East 2nd Ave., Fort Pierre, SD 57532 on or before 4:00 p.m. CDT on April 10, 2018.

 

All comments received will be considered and the City of Fort Pierre will not request the release of Federal funds or take any administrative action on the project prior to the date specified in the preceding sentence.
 

The City of Fort Pierre will undertake the project described herein with Community Development Block Grant funds from the Governor’s Office of Economic Development under Title I of the Housing and Community Development Act of 1974. The City of Fort Pierre is certifying to the Governor’s Office of Economic Development that City of Fort Pierre and its Chief Executive Officer or other Certifying Officer approved by the Governor’s Office of Economic Development in her/his official capacity as Project Environmental Officer consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision-making and action; and that these responsibilities have been satisfied.  The legal effect of the certification is that upon its approval the City of Fort Pierre may use the Block Grant funds and the State and HUD will have satisfied their responsibilities under the National Environmental Policy Act of 1969.

 

The Governor’s Office of Economic Development will accept an objection to its approval only if it is on one of the following basis:  (a) that the certification was not in fact executed by the environmental certifying officer or other officer of applicant approved by the GOED, or (b) that applicant’s environmental review record for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process.  Objections may be addressed to the Governor’s Office of Economic Development, Community Development Block Grant Program, 711 E. Wells Avenue, Pierre, South Dakota 57501-3369.

 

Objections to the release of funds on basis other than those stated above will not be considered by the GOED.  No objection received after April 26, 2018 will be considered by the State.
